TERMS AND CONDITIONS FOR CURTFIRE

 

Definitions:

 

Curtfire

An e-commerce platform that sells products and services from various vendors powered by Transhuman Technologies in which various brands and manufacturer utilise to create an online marketplace and distribution channel.

 

Business Days

Means any day that is not a Saturday, Sunday or a public holiday gazetted in the Republic of South Africa from time to time.

Goods

Means the item of goods and products manufactured for sale and/or sold on the Curtfire platform by the registered Third-Party Sellers

Third Party Seller

Means any sellerindependent of an operator  and/or online marketplace (Curtfire) who sellsoffers to sell, or contracts to sell a consumer product  through an Curtfire website/App/Platform.

  1. DELIVERY POLICY

 

  • The Good and/or Service shall be delivered to and/or rendered on Curtfire as agreed by the parties in writing.
  • The price quoted by the Third-Party Seller of Goods shall include delivery.
  • The Third-Party Seller shall ensure that each delivery is accompanied by a delivery note containing the purchase order number, date of the purchase order, number of packages and contents and, in the case of part delivery, the balance to be delivered.
  • Deliveries shall be made during business hours being 08h00 to 17h00, unless alternative arrangements are agreed to by the Third-Party Seller and the customer.

 

 

 

 

 

  1. RETURNS AND REFUND POLICY

 

  • This policy applies to the return of goods bought on our Curtfire platform.
  • You must ensure that you present your original tax invoice or other proof of purchase when retuning goods.

 

  • Where the goods in question are not defective or where you do not have statutory right to return the goods, the Third Party Seller may, in its sole absolute discretion, elect to accept returns and replace the goods in question or refund the consumer. Where the Third Party Seller does so, this is done so in good faith. It is not an admission of liability, nor should it be taken as an acknowledgment that the Third Party Seller accepts similar returns in the same basis in the future.

 

  • The Third Party Seller is only bound to accept the return of goods when it is required to so in terms of relevant law, including in terms of the Consumer Protection Act 68 of 2008. In any other case, the Third Part Seller:

 

  • Does so in its sole and absolute discretion in each instance; and
  • May, in its sole discretion, elect whether to replace the goods or refund the consumer.

 

  • Collection or acceptance of returned goods by the Third party seller, even where the consumer believes it has statutory right to return goods, does not constitute acceptance of liability by the Third party seller.

 

  • Where you believe you have statutory right to return goods the provisions set out in clauses set out below apply:

 

  • Return of unsafe or defective goods

 

  • If within 30 days of delivery of good to you, you find that the goods are faulty, not commercially acceptable, or unsuitable for the purpose generally intended, you may contact us to arrange for the goods to be collected to ascertain if they are in fact unsafe and/or defective.

 

  • If the goods are unsafe and/or defective, without paying a penalty fee and at the expense of the Third-Party Seller, you may request, at your choice, that the goods be repaired or replaced or that you be given a refund.

 

  • If the goods are not found to be unsafe and/or defective, then you will be liable for the costs associated with the collecting and inspecting the goods.

 

  • The Third-Party Seller reserves the right to send the returned goods for technical assessment prior to repairing, replacing, and refunding therein.

 

  • If you choose to repair the goods in question during the 30 days period contemplated above, such repairs will carry a further warranty of 3 months from the date of repair.

 

  • In the event of the goods being unsatisfactorily repaired or if any further failure or defect is discovered within 3 months from date of repair, you will be entitled to request the Third-Party Seller to either replace the goods or refund you the money paid for the goods.

 

  • In relation to the quality or durability of goods, please note that they will not be considered defective if:

 

  • You have been expressly informed that goods were offered in a specific condition; and

 

  • You have expressly agreed to accept such goods in that condition, or knowingly acted in a manner consistent with accepting the goods in that condition.

 

  • Returns for goods purchased as a result of direct marketing

 

  • The Third Party Seller will accept returns of goods purchased as a result of direct marketing by the Third Party Seller, provided that you notify the third party seller of your intention to return the goods within 5 business days after the goods were delivered to you and you return the goods, at your own risk and expense, to us within 10 business days from the date on which the goods were delivered to you.

 

  • Other returns:

 

The Third-Party Seller will accept returns-

  • Where you were not given a reasonable opportunity to examine or inspect goods prior to delivery and you reject the goods on the basis thar they are not of the type or quality reasonably contemplated or do not conform to the agreed specifications in the case of custom-made or special-order goods.

 

  • Where goods that you ordered have been mixed with goods that you did not order (and in this case you may return all the goods and only those that differ from what you ordered).

 

  • Where the goods have ordered are not suitable for their intended specified purpose (provided that the specified purpose was communicated to the Third-Party Seller, and they agreed to supply the goods in that basis); and

 

  • Provided that in all cases the goods are returned to within 10 business days after delivery.

 

  • In instances relating to the return of goods, the Third-Party Seller may impose a reasonable charge where:

 

  • the goods are not in their original condition-i.e., damaged packaging, partially consumed and/or that are not in a saleable condition.
  • the goods returned in boxes or packaging have been re-marked, damaged, or defaced in any way, including price stickers; or
  • the goods have been depleted or consumed in excess of the amount reasonably necessary to determine that the goods were unacceptable.

 

  • Notwithstanding the provisions above, no returns will be accepted if:
    • the return is prohibited for public health reasons.
    • any other public regulation prohibits the return of the goods for whatever reason.
    • the goods have been altered contrary to the Third Party Seller’s or the manufacturer’s instructions after leaving our control;
    • the goods have been partially or entirely disassembled; or
    • the goods have been permanently installed, affixed, attached, joined or added to, blended or combined with, or embedded within, other goods.

 

  1. CUSTOMER PRIVACY POLICY

 

  • Transhuman Technologies shall take all reasonable steps to protect the personal information of users. For the purpose of this clause “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA).   1. PAYMENT OPTION ACCEPTED.

 

We are committed to proving secure online payment facilities. All transactions are encrypted using appropriate encryption technology.

  • Whether the goods are for sell by a Third-Party Seller, payment may be made for goods via Visa and MasterCard in the following forms:

 

  • Debit Card:
  • Credit Card

 

  • Payment may also be made via direct deposit or electronic transfer to the Third-Party Seller account.

 

  1. GIFT VOUCHERS & COUPONS

 

  • Transhuman Technologies may from time to time make physical or electronic vouchers and promotional coupons or discounts coupons available for use on the Curtfire platform towards purchase of goods and service on the platform. Gift Voucher and Coupons can only be redeemed while they are valid, and their expiry dates cannot be extended.

 

  • VOUCHERS

 

  • All Vouchers that are purchased on our Curtfire platform are valid for two (2) years after sale. In event that your Voucher has not been used within that period will expire.
  • Vouchers cannot be used to buy Vouchers or Coupons. They do not accrue interest and are not refundable for cash once purchased or otherwise obtained. If your Voucher is less than the amount required to cover the full order you wish to place, you may make up the difference by paying via one of our other payment methods.
  • Some of our vouchers may be redeemed at certain retailers and wholesalers (Third-Parties) that we work with subject to the Third-Parties terms and conditions.

 

  • COUPONS

 

  • There are two types of Coupons: a Coupon with a fixed amount of discount and coupon with a percentage discount.
  • Coupons are issued in Transhuman Technologies. Shop’s sole discretion and we are entitled at any time to correct, cancel, or reject a Coupon for any reason. Users do not have any right to Coupons and Coupons cannot be earned.
  • Coupons are issued under specific terms and conditions regulating when and how they may be used.
  • Coupons:
    • May only be used once.
    • One Coupon can be used per order.
    • Coupon can only be used at check-out- it cannot be used later on existing orders.
    • The value of the Coupon will set off against the value of your shopping basket and the balance remaining, if any, will be payable by you.

 

  1. CARD ACQUIRING AND SECURITY

 

  • Card transaction will be required for Transhuman Technologies via PayStack Payment gateway who are an approved payment gateway for all South African Acquiring Banks. PayStack uses the strict form of encryption. Users may go to paystack.com to view their security certificate and security policy.

 

  1. CUSTOMER DETAILS SEPARATE FROM CARD DETAILS

 

  • Customer details will be stored by Transhuman Technologies separately from card details which are entered by the client on PayStack’s secure site. For more details on PayStack refer to paystack.com

 

  1. MERCHANT OUTLET COUNTRY AND TRANSACTION CURRENCY

 

  • The merchant outlet country at the time of presenting option to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

 

  1. RESPONSIBILITY

 

  • Transhuman Technologies takes responsibility for all aspects relating to the transaction including sale of goods and service on the website, customer service and support, dispute resolution and delivery of goods.
  1. Transhuman Technologies may, in its sole discretion, change this agreement or any part thereof at any time without notice.

 

  1. This website is run by Transhuman Technologies a private company based in South Africa and Zimbabwe trading as Transhuman Technologies.
